This JVC Lucky Draw (“Promotion”) is organized and promoted by JVC Europe Limited, JVC House, JVC Business Park, 12 Priestley Way, London NW2 7BA, United Kingdom (“Promoter”). It is governed by the laws of England.
・No purchase is necessary to take part in this Promotion.
・On the close of the Promotion, one participant, randomly chosen, will win a JVC Home Cinema Package, comprising of a 32” LCD TV and a Home Cinema DVD System as set out in more detail below and in accordance with these terms and conditions.
1. (Participation)
・Participation in the Promotion is free of charge, with no obligation of purchase. The Promotion can only be entered online via the JVC EUROBALL football game at the website www.JVCfootball.com. Entries submitted by any other method will not be accepted
・The Promotion is open to anyone [over the age of [ ]] with a personal email address and who is resident permanently inside any of the countries or territories that has a national football association which is a member association of the Union of European Football Associations (UEFA) as at the start date of this promotion.
・In order to be eligible to win the prize, the participant must provide the Promoter with his/her name and email address to enter this Promotion. The Promoter reserves the right to use the winner's names in marketing/press literature concerning this Promotion and, by provision by the participant of his/her name and email address, he/she agrees to such use.
・Entries are limited to one per person. However, each participant can increase his/her chances of winning by sponsoring friends. The participant will be given the opportunity to provide up to a maximum of five (5) email addresses of friends who may be interested in the JVC EUROBALL football game or the Promotion and each email address provided will give the participant an additional entry into the Promotion (up to a total maximum of six (6) entries). The addresses provided by the participant must be individual, valid, in use and not held by the participant to be counted. The participant is responsible for obtaining the prior consent of the owners of the email addresses provided to receive an e-mail invitation from the Promoter or its agent, on behalf of the participant, to participate in the JVC EUROBALL football game and the Promotion. The participant will indemnify and hold the Promoter harmless from and against all liability arising from the use of the email addresses provided by the participant. Email addresses provided by the participant will only be used to send an invitation to participate in the the Promotion and any promotion connected with the JVC EUROBALL football game.
・This Promotion is not open to employees and contractors (and their families) of the Promoter or any person directly or indirectly involved in the running of this Promotion.
2. (Qualifying Period)
・The Promotion will be open from midnight on 1 November 2007 and will close at midnight 2 July 2008.
3. (How to Participate)
・After playing the JVC EUROBALL football game atwww.JVCfootball.com, have the choice to participate in the Promotion by entering their name and email address using the entry form provided as part of the JVC EUROBALL football game.
4. (Drawing of Winner)
・On _____, 2008 a random draw of all eligible entries will be made for the prize by a third party. The Promoter’s agent for the Promotion, Rubber Production, 12 Ropemakers Court, 11 Lower Park Row, Bristol, BS1 5BN, United Kingdom, will be responsible for conducting this draw.
・The decision of Promoter concerning the determination of the winner will be final. No correspondence will be entered into.
・The name of the winner can be obtained by sending a stamped addressed envelope to the marketing department of the Promoter at the address below.
5. (Notification of Winning)
・The winner will be notified via email within 7 working days from the draw. If no response is received from the winner within 5 working days from the date that the email is sent by the Promoter or its agent, the Promoter will assume that the prize has been refused and the winner will automatically forfeit his/her right to claim for the prize. A further draw may be held with a new winner selected. An unclaimed prize may, at the Promoter’s discretion, not be awarded.
6. (The Prize)
・The prize for the winner of the Promotion will be a JVC Home Cinema System, which comprises a32” LCD TV and DVD Home Cinema System.
・The prize as stated must be taken by the participant and no alternative may be chosen. There will be no cash alternatives and the prize is non-transferable. In the event that the prize is not available, the Promoter reserves the right to substitute the prize with an alternative prize of a similar value, at its discretion.
7. (Limitation of Liability and Miscellaneous Terms)
・The Promoter does not accept any responsibility for entries that are incomplete, not registered properly, delayed or lost for any reason, or which otherwise do not reach the Promoter for any reason, including as a result of Internet failure. The date and time of receipt by Promoter will be taken as the conclusive date of entry by the participant and proof of sending or transmission is not proof of receipt. Failure of any entry to be delivered by ________2008, or in the manner specified, or any failure of any entry to meet these terms and conditions will render the entry invalid.
・The Promoter reserves the right to cancel or change the Promotion or any terms and conditions applicable to the Promotion at any stage, in its discretion, for any reason, and without notice.
・Participants will be deemed to have accepted these terms and conditions and agree to be bound by them by entering this Promotion.
・All disputes arising out of or in connection with the Promotion and/or these terms and conditions are subject to the exclusive jurisdiction of the English Courts.
8. (Security and Privacy)
・As part of the Promotion, participants are required to give certain contact information, including their name and email address. In compliance with applicable data protection and privacy laws, participants are asked to indicate whether they authorize JVC to use their personal data in the future to send them information about JVC, its products and/or promotions. Participants have the right to access and modify their personal details. Notwithstanding the foregoing, the Promoter reserves the right to use the winner's names in marketing/press literature concerning this Promotion and, by provision by the participant of his/her name and email address, he/she agrees to such use.
